The petitioners apprehend their arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. As per the prosecution case, one tractor loaded with 100 cft of illegal sand was seized by the police. Petitioner no. 1 is owner and petitioner no. 2 is driver of the vehicle in question. It is submitted that petitioners are ready to pay the estimated loss amount of illegal sand which comes to Rs. 18,000/- as per the market value. Petitioners claim clean antecedent.

No.13767 of 2022(4) dt.15-09-2022 2/2 In view of the undertaking given by the petitioners, the petitioners above-named are directed to deposit the said amount within a period of two weeks from today, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Khudaganj P.S. Case No. 46 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
