The petitioner seeks regular bail in connection with Adarsh Thana Jamui PS case no. 341 of 2018 registered for the offence punishable under Sections 406, 420 of Indian Penal Code.

The allegation is regarding the sole accused person namely Tilia Devi having misappropriated the amount under the Pradhan Mantri Awas (Gramin) Yojna by suppressing her original identity. It is further alleged that the other persons of the Panchayat viz. Mukhia, Sarpanch etc. are also involved in the said misappropriation of money.

The learned counsel for the petitioner submits that the said accused person namely Tilia Devi has already

No.11851 of 2019(2) dt.26-02-2019 2/2 deposited the misappropriated amount, as is apparent from the certificate issued by the Block Development Officer, Jamui, annexed as Annexure-2 to the present bail petition. It is further submitted that the petitioner has got nothing to do with the alleged incident, as is apparent from the F.I.R. and she is having clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 12.01.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Jamui in connection with Adarsh Thana Jamui PS case no. 341 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
