JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-07-2022 Perused the report as contained in letter no. 75/2022. The learned trial court has requested for extension of time for at least three months to conclude the trial.

Learned counsel for the petitioner submits that the petitioner is in the observation home/safety home since 13.05.2016.

In view of the report of the learned Children's Court, this Court is of the considered opinion that instead of considering the prayer for bail on appreciation of the deposition of witnesses who have deposed in course trial, it would be just and proper to allow three months time to the learned Children's Court to conclude the trial itself.

In the interest of justice and to avoid delay in conclusion of trial, this court deems it just and proper to refuse

Patna High Court CR. REV. No.619 of 2017(8) dt.12-07-2022 2/2 bail to the petitioner at this stage.

Since the petitioner has already remained in the observation home/safety home for over six years, the Children's Court must keep the records of this case on day to day basis and all endeavours be made to conclude the trial within three months period from the date of communication of this order. If any official witness is required to be examined, the attendance of the said official witness be procured through the process of court and the Superintendent of Police, Aurangabad must cooperate failing which he may be held responsible for delaying the trial. If the trial still remains unconcluded for no reason attributable to the petitioner, he will be at liberty to file a fresh application for bail in the learned Children's Court which may be considered by the court on the basis of the materials available on the record within a reasonable period.
