JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.10.2017, seeks bail in Motipur PS Case No. 377 of 2017 registered under Sections 399, 402, 413, 414 of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The allegation in brief is that on suspicion the police apprehended three youths, including the petitioner, and from the possession of the petitioner one live cartridge was recovered and from the two motorcycles total 150 grams of ganja was recovered. Learned Counsel for the petitioner submits that only recovery from the possession of the petitioner, as alleged, is one live cartridge, the motorcycles are not of this petitioner, besides this he has clean antecedent and is in custody since 18.10.2017. Having considered the said facts and circumstances, the petitioner, namely, Anish Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge -cum- Special Judge, Muzaffarpur in connection with Motipur PS Case No. 377 of 2017.
