This is a case registered under Sections 272,273,308 of the Indian Penal Code and Sections 30-A/38(1) of Bihar Excise Act.
Counsel for the petitioner submits that he has been falsely implicated in the case as would be evident from the fact that even though the FIR alleges that three persons were sitting at the place of occurrence, but only the petitioner has been apprehended. He further submits that the seizure list witnesses are police man, chowkidar and his son and there is no independent witness to support the presence of the petitioner. He also submits that the petitioner is an employee at Jewelry shop of one Mahesh
Patna High Court Cr.Misc. No.28529 of 2017 (2) dt.01-07-2017 2/2 Prasad and has no concern with the alleged recovery of liquor. The petitioner has no criminal antecedent prior to the instant case and he is in custody since 12.01.2017.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate X, Siwan in Siswan P.S. Case No. 07 of 2017.
