The instant petition has been filed for grant of regular bail in connection with Bihar PS case no. 44 of 2017 registered for the offences punishable under Sections 399, 402 of Indian Penal Code and Sections 25(1-B)A, 26, 35 of Arms Act. The allegation leveled against the petitioner is that police had conducted raid in the house of one co-accused Satyendra Kumar and recovered arms. The petitioner was apprehended on the spot and from his possession, one pistol was recovered.

Learned counsel for the petitioner submits that petitioner is young who is pursuing his educational carrier, he is in custody since 27.01.2017. He further submits that any further

Patna High Court Cr.Misc. No.21278 of 2017 (3) dt.14-06-2017 2/2 incarceration will jeopardize his carrier and make him a hardened criminal. He next submits that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, I find it a fit case where the petitioner may be released on bail.

Accordingly, the abovenamed petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rs. Twenty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Biharsharif in connection with Bihar PS case no. 44 of 2017.
