JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-03-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Jehanabad Rail P.S. Case No. 58 of 2018 for the offenses under Sections 379/411of the Indian Penal Code.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. The petitioner is not named in the FIR. In fact the petitioner has purchased a mobile from a person of his Mohalla. The said Mobile was turned to be stolen one. Under the aforesaid circumstances the petitioner is suspected to be involved in theft of mobile. The petitioner is in custody since 2.1.2019.

Considering the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged
