JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-08-2021 Heard the parties through virtual court proceeding. It is a third attempt made by the petitioner for grant of regular bail in a case registered for the offence punishable under Sections 147, 302, 201, 504, 506 of the Indian Penal Code. In pursuance to the order dated 28.07.2021, status report of trial in connection with Sessions Trial No. 102 of 2019 arising out of Telhara P.S. Case No. 166 of 2018 has been received and kept at Flag-R, in which it is reported that summons were issued to the witnesses and court directed to the office to issue reminder letter to non-official witnesses. But due to Covid-19, no any witnesses has been produced by the prosecution and presently the case is running for prosecution evidence.
Considering the present stage of the trial, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer
Patna High Court CR. MISC. No.23195 of 2021(3) dt.25-08-2021 2/2 for bail is rejected in connection with Sessions Trial No. 102 of 2019 arising out of Telhara P.S. Case No. 166 of 2018 pending before the court of the learned Additional Sessions Judge 2nd Hilsa (Nalanda).
Accordingly, the application is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of six months from the date of initiation of normal physical proceeding and /or through Video Conferencing and S.P., Nalanda is directed to ensure production of the witnesses in the case on each and every date fixed without fail.
