Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Laukaha P.S. Case No. 13 of 2023 dated 14.01.2023 registered for the offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

The main submissions advanced by learned counsel for petitioner are that as per the prosecution's story 243 litres of Nepali liquor is stated to have been recovered from a Bolero vehicle and petitioner has been shown as being seated in the said vehicle but in actual the petitioner was not present in the said vehicle, he has been falsely made accused in this case and he had no concern with the said vehicle as well as the alleged wine which is stated to have been recovered from the said

Further submissions are that the petitioner has fair and clean antecedent and he has been languishing in jail since 14.01.2023 and he is neither owner nor driver of the seized vehicle and against him the investigation has been completed. 4.

Learned APP for the State has opposed the bail prayer of the petitioner.

Considering the above submissions and mainly the petitioner's fair and clean antecedent, his custody period and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Laukaha P.S. Case No. 13 of 2023.
