JUSTICE SANJAY PRIYA ORAL ORDER 10-04-2019 Heard the learned counsel for the petitioner and the State. The petitioner seeks bail in Majhaulia P.S. Case No. 212/2018, instituted for offence under Sections 304B, 201 and 34 of the Indian Penal Code.

It is alleged in the written report that daughter of informant was married with this petitioner about three years ago. After marriage, she was tortured in her Sasural for non-fulfillment of demand of motorcycle and cash of Rs. 2 lacs. It is alleged that on 04.06.2018 in the night the accused persons including the petitioner caused her death and disposed off her dead body. Thereafter the accused persons informed the informant that his daughter is ill. The informant and others went to the Sasural of his daughter and found the dead body of his daughter has already been disposed off. Earlier prayer for bail of petitioner was rejected by this Court on merit, vide order dated 09.10.2018 passed in Cr. Misc. No. 57501/2018.

Report from the Court below regarding present stage of case has been received, from which it appears that case is fixed for commitment.

The Court below is directed to commit the case without delay within a period of one month from the date of receipt of this order.

The Learned District & Sessions Judge, West Champaran will personally monitor the case for expeditious disposal of the same. No fresh ground has been made by the learned counsel for the petitioner at this stage to consider the bail of the petitioner afresh. Accordingly, prayer for bail of petitioner is again rejected. Petitioner will be at liberty to renew the prayer for bail in the event trial is not concluded within nine months. (Sanjay Priya, J) rakhi/- U T
