Informant who happens to be active member of Mahila Brigade while was returning after convening a meeting with its member fallen prey at the hands of accused including the petitioner who assaulted, misbehaved, took away mobile, purse etc. During course of investigation it has come up informant and accused persons are resident of same mohalla and there happens to be dispute relating to drainage which ultimately resulted in such kind of activity. Para-41 speaks simple injuries having over the person of members of the prosecution party. Furthermore, the allegation too happens to be indefiniteness as well as omnibus.

That being so, petitioner Pramod Kumar Nirala is directed to surrender before the learned lower court with a prayer for bail which the learned lower court will consider in light of aforesaid finding.

Patna High Court Cr.Misc. No.10553 of 2015 (3) dt.05-05-2015 With the aforesaid observation, instant petition is disposed of.
