The petitioner seeks bail in G.O. Case No. 1667 of 2017 arising out of Bahera P.S. Case No. 383 of 2017 registered under Sections 30(a), 32(3), 41(1) and 37(b) of the Bihar Prohibition and Excise Act, 2016 and Sections 25(1-b)a, 26(ii) and 35 of the Arms Act.
70.500 litres of foreign liquor is said to have been recovered from the house, vehicle and school run by accused Dinesh Sahni. The said accused named the petitioner in the
Patna High Court Cr.Misc. No.22492 of 2018 (2) dt.17-04-2018 2/2 occurrence as one of his accomplice in the occurrence. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the place of recovery. He has been falsely implicated in the case by co-accused Dinesh Sahni due to animosity. He was not apprehended on the spot. He has no criminal antecedent. He has been languishing in custody since 22.01.2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-IV cum Special Judge, Darbhanga in connection with G.O. Case No. 1667 of 2017 arising out of Bahera P.S. Case No. 383 of 2017.
