This is the second attempt of the petitioners for grant of anticipatory bail in connection with Mahua P.S. Case No.793 of 2021, registered for the offence punishable u/s 147, 148, 149, 323, 324, 307, 380, 354, 504, 506 and 325 of the IPC. 3.

Earlier, the anticipatory bail application of the petitioners was rejected on merit vide order passed in Cr. Misc. No.24207 of 2022 dated 08.01.2024.

Learned counsel for the petitioners submits that both sides have sustained grievous injury and there is an admitted land dispute between the parties.

Considering the aforesaid facts, without going into the merit of the case, this anticipatory bail application is hereby disposed of with a liberty to the petitioners to surrender before the learned Court below within a period of six weeks from today and seek regular bail.

The learned Court below is directed to pass the order, preferably, on the same day, in accordance with law, keeping in view the order passed by the Apex Court in the case of Satendra Kumar Antil v/s. Central Bureau of Investigation & Anr. as reported in (2022) 10 SCC 51 and considering that both sides have sustained grievous injury and there is admitted land dispute between the parties.
