Mr. Shailendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-09-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner apprehends his arrest in connection with Pirbahore P.S. Case No. 793 of 2024, registered for the offences punishable under Sections 21, 22(b) and 22(c) of the NDPS Act, 1985.

3. As per the prosecution story, the informant received the information that illegal medicines are stored in a room on the 2nd floor of the house of co-accused Pinki Devi. On search, large quantity of psychotropic medicines were recovered.

4. The learned senior counsel for the petitioner has submitted that the premises wherefrom the injections and medicines are recovered, is not in possession of the petitioner.

Patna High Court CR. MISC. No.13551 of 2025(4) dt.23-09-2025 2/2 The owner of that premises is co-accused Pinki Devi. It is further submitted that there is no rent agreement.

5. On the other hand, Mr. Shailendra Kumar, the learned APP for the State has opposed the prayer for bail by submitting that the petitioner owns a medical shop and he has taken the premises of Pinki Devi on rent for storage of the drugs and he has stored the psychotropic drugs in that premises.

6. Considering the above-mentioned facts and circumstances, the petitioner does not deserve the privilege of anticipatory bail. Accordingly, the application stands rejected.

7. The petitioner is directed to surrender before the learned Court below and make prayer for regular bail which shall be disposed of without being prejudice of this order. (Nawneet Kumar Pandey, J) priyanka/- U T
