Petitioner seeks bail in connection with Dhamdaha P.S. Case No. 144 of 2016 registered under Sections- 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that on medical examination no spermatozoa was found, no sign of sexual intercourse and the age of the victim was alleged to be 15 to 17 years. In her statement under section 164 Cr. P.C. the victim did not make any allegation of physical or mental harassment against the petitioner. Petitioner has no criminal antecedent and is in custody since 31.01.2017. Considering the facts and circumstances of the
