Petitioners seek bail in a case registered for the offences punishable under Sections 394, 307 of the Indian Penal Code and Section 27 of the Arms Act.
The FIR of the occurrence is against unknown. Name of the petitioners surfaced in the confessional statement of co-accused Pankaj Singh.
Submission is that the petitioners are in custody since 10.01.2018. Nothing has been recovered from possession of the petitioners. The petitioners were never put on TIP. Investigation of the case is already complete. Co-accused
Patna High Court Cr.Misc. No.24269 of 2018 (2) dt.26-04-2018 2/2 Damodar Singh has already been allowed bail by a Coordinate Bench of this Court vide order dated 17.10.2017 passed in Cr. Misc. No. 48957 of 2017 and case of the petitioners are similar to Damodar Singh.
Considering the criminal antecedent of the petitioners, let the petitioners, above named, be released on bail after framing of the charge or after completion of four months of custody whichever is earlier on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhorey Police Station Case No. 152 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
