2. The petitioners apprehend their arrest for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
3. A perusal of the first information report and the seizure list would go to show that a total 490.155 liters of foreign liquor has been recovered from a hut like structure of Asha Devi, who is petitioner no.2. It has been stated that Arun Roy and Akhilesh Roy were instrumental in getting the said consignment brought to the said place.
4. Learned counsel for the petitioners submits that

No.12294 of 2025(3) dt.09-05-2025 2/3 petitioner no.1 has been made accused in this case upon a confidential information received by the police, while petitioner no.2 has been made accused on account of the fact that the said hut like structure belongs to her. As a matter of fact, petitioner no.2 is not residing in the said hut and the same remains deserted and she has no knowledge whatsoever of any illegal activity committed from the said place. So far as petitioner no.1 is concerned, he is neither associated with the other co-accused nor has any concern with the said illegal activity. It is also a fact that the petitioners were not caught on the spot and nothing has been recovered from their physical or conscious possession.

Taking into consideration the abovementioned facts and circumstances of the case and further that the petitioners have no criminal antecedent, I am inclined to extend the privilege of anticipatory bail to the petitioners. Let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/ successor Court in connection with Bishanpur P.S. Case No.147 of 2024, subject to the condition as
Patna High Court CR. MISC. No.12294 of 2025(3) dt.09-05-2025 3/3 laid down under Section 438 (2) of the Cr.P.C. and subject to the further condition that the petitioner shall cooperate in the investigation/trial.
