JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned counsel representing the State.

The petitioner seeks bail in connection with Complaint Case No.1786 of 2013 registered for the offence punishable under Section 498(A) of the Indian Penal Code and Section 3/4 of the D.P. Act.

Allegedly, the petitioner being the husband of the complainant whose marriage was performed on 21.05.2013 started demanding dowry by way of one motorcycle and due to nonfulfillment started torturing her and lastly ousted her from the inlaws house.

Patna High Court Cr.Misc. No.14161 of 2017 (4) dt.22-06-2017 2/2 Submission is of false implication and that the petitioner never demanded anything, he never tortured the complainant, he keeps her properly with honour and dignity but she herself fled away from in-laws house, she does not want to live with this poor petitioner. The petitioner has remained in custody for about five and half months and, as such, the petitioner deserves sympathetic consideration.

Learned A.P.P. duly assisted by the learned counsel for the opposite party no.2 opposes the prayer of bail by submitting that petitioner is the husband and he is responsible for all the acts.

In the facts and circumstances stated above, the provisional bail granted to the petitioner by order dated 17.04.2017 is hereby confirmed.
