JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-07-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through Video Conferencing. The petitioners apprehend their arrest in connection with Tilauthu P.S. Case No.101 of 2019 registered under Sections 147, 149, 341, 323, 307, 379, 384, 504 and 506 of the Indian Penal Code.

The accusation is that when the truck bearing Registration No.BR24GA-8442 belonging to the informant Sunil Kumar Singh reached at village-Hurka, then 10-12 persons intercepted the truck and made demand of ransom saying that if the demand of ransom is not paid, then they would

Thereafter, on the point of gun, they got down the driver from the truck and while abusing, caused injury to him. When the informant after receiving the information about the same from his driver on mobile went there, then they also attacked at him and snatched cash Rs.80000/- and gold chain from the informant. In the F.I.R., the informant has disclosed the name of eight persons including the petitioners having indulged in the said occurrence, while he could not identify some others.

Learned counsel for the petitioners submits that the truck of the informant was parked in the village of the petitioners and the driver of the said truck was playing music. When the protest was made by the petitioners and others regarding the same, the informant lodged the present case against the petitioners and others with false allegation. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Dehri,
