Petitioner has been reagitating the issue of his seniority and promotion with one Mr. Muneshwar Paswan as referral point, who, the petitioner alleges is junior to him. Matter was also earlier raised by the petitioner before this Court and the order passed has been annexed by the petitioner himself as Annexure-3.

Again the issue was raised and the petitioner filed a writ application, which was C. W. J. C. No. 22496 of 2012, where in the counter affidavit the respondents clearly indicated the seniority position of the petitioner. The same, however, did not satisfy the

Patna High Court CWJC No.8074 of 2014 dt.05-08-2016 2/2 petitioner. Therefore, the matter was left open for him to do whatever he wanted to do on the issue.

Yet another writ application has now been filed reiterating the same fact, when the basic decision indicating that there was at least 14 people senior to the petitioner, who have been given the benefit and nobody junior to the petitioner has been promoted. The claim of the petitioner further to revise his order of promotion from a back date is also rejected.

Repeated writ applications does not make the case of an individual any better, especially when he has not been able to demonstrate or rebut the position indicated by the respondents for refusal of the relief, which he is looking for. In view of the same, mere demand or an allegation of somebody being junior to the petitioner, does not make out a case when such materials and the decision on that issue does not reflect that position.
