This is a petition for grant of regular bail for offence under Sections 406, 409 and 420 of the Indian Penal Code. The petitioner was In-Charge Principal. Money was allocated for completion of school building, lavatory, kitchen etc. However, the work was not completed.

Submission of the learned counsel for the petitioner is that the petitioner has already completed major portion of the work, which would reveal from Annexure 2 and the petitioner had filed affidavit assuring completion of the remaining work within few months, vide his affidavit, dated 25.01.2017, at Annexure 3. However, the authorities lodged the first information report in February, 2017.

Submission before this Court is that soon after the bail of the petitioner, the entire work would be completed within two months from the date of his release.

Considering the aforesaid undertaking, let the petitioner, above named, be released on bail on furnishing bail
