The petitioner, already in custody, seeks bail in connection with Harsidhi P.S.Case No. 335 of 2017, registered under Section 392 of the Indian Penal Code.
Allegation in brief is that some unknown miscreants looted away the motorcycle of the informant.
Learned counsel for the petitioner submits that though he was not named in the First Information Report but on the basis of confessional statement of co-accused, Jahir Alam, made before the police, the petitioner has been taken into custody but neither put on T. I. Parade nor any recovery was made from his conscious
Patna High Court Cr.Misc. No.9771 of 2018 (2) dt.19-02-2018 2/2 possession. It is further submitted that other co-accused Izhar Alam has been granted bail by a Co-ordinate Bench of this Court vide order dated 01.02. 2018 passed in Cr. Misc. No. 5583 of 2018 and the Investigation is complete and the petitioner is in custody since 27.10.2017.
Having considered the said facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S.Case No. 335 of 2017.
