NILU AGRAWAL ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in jail since 16.09.2016 in a case registered for offences punishable under Sections 356 and 379 of the Indian Penal Code.

The prosecution case as lodged by the informant is that while he had taken out Rs. 1,80,000/- from S.B.I., Nawada Branch, two miscreants snatched money, which was kept in a bag.

It has been submitted by the learned counsel for the petitioner that he is not named in the F.I.R. and has been apprehended by the police merely on the basis of suspicion, as there are seven cases pending against him. It has been further

He further submits that the petitioner is in custody since 16.09. 2016 and no T. I. Parade has been done so far. He further submits that another accused on similar footing has been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 15109 of 2017 dated 26.04.2017 dated 26.04.2017.

Considering the facts and circumstance of the case and materials on record, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction of learned Chief Judicial Magistrate, Bhojpur in Arrah in connection with Arrah Nagar P.S.Case No. 302 of 2016, subject to the condition that one of the bailors must be a close relative of the petitioner, who will file an affidavit stating his relationship with the petitioner.
