The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 498(A), 323 of the Indian Penal Code and the cognizance has been taken under Section 498(A).
the allegation against the petitioner (husband of the complainant) and others is that they tortured, tried to burn the complainant and lastly ousted her from her

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is further submitted that complainant did not want to live with the petitioner in matrimonial house and as per her own will she left the house without consent of petitioner and she is living with one Rajvir Pandit after solemnization her second marriage. Moreover, the petitioner suo-motto surrendered before Court below on 14.22.2022 and since then he is languishing in judicial custody. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Learned APP appearing for the State has vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody,
Patna High Court CR. MISC. No.14274 of 2023(2) dt.26-04-2023 3/3 this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Complaint Case No. 2115 of 2017 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West Champaran, Bettiah.
