2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 30(a) of the Bihar Prohibition and Excise Act.
3 . It is alleged that 6048 liters of spirit was recovered from seized truck and car.
4. Learned counsel appearing for the petitioner submits that petitioner is neither owner nor driver of the seized vehicles. No incriminating material has been recovered from the conscious possession of petitioner and has got no concern with the alleged occurrence . In this case , Charge has already been framed against this petitioner vide order dated 04.07.2025 . Petitioner is in custody since 15.12.2024 .

6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional sessions Judge cum Presiding Officer, Exclusive special Excise Court- 3 Saran in connection with Taraiya P.
