JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the bail prayer of the petitioner was twice rejected by this court but submission on behalf of the petitioner is that having similar allegation co-accused, Awadhesh Singh and Babu Sahib @ Babu Saheb Singh have already been granted bail by different Benches of this Court.

It is further submitted on behalf of the petitioner that petitioner is in jail custody since 14.07.2015 and there is no likelihood of conclusion of trial of the petitioner in near future. Till 24.01.2017 only six prosecution witnesses had been examined.

Considering the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.10150 of 2018 (2) dt.28-02-2018 2/2 particularly, taking note of this fact that having similar allegation some co-accused have already been granted privilege of bail, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st Banka in connection with Sessions Trial No. 66/2016, 222/2016, 23/2016 arising out of Amarpur P.S.
