Petitioner apprehends his arrest in Jalalpur P.S. Case No. 44 of 2014 registered under sections 403, 406, 420 of the Indian Penal Code.
The petitioner is go-down in-charge of the fodders meant for hen. The petitioner sold the fodder and deposited Rs. 5, 84000/- in the account of the company and about Rs. 5, 61000/- is still lying against the petitioner petitioner is ready to make payment as soon as the amount is received by the petitioner from the purchaser. The petitioner undertakes to deposit the entire amount within three months.
Patna High Court Cr.Misc. No.15572 of 2015 (3) dt.26-06-2015 2/2 Learned counsel for the informant did not dispute the fact that Rs. 5,61000/- is due against the petitioner. Considering the fact that petitioner undertakes to pay the remaining amount within three months, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri S.C. Shrivastava, J.M. Ist Class, Chapra, Saran, in Jalalpur P.S. Case no. 44 of 2014 subject to the conditions laid down under section 438(2) Cr.P.C. It is made clear that if the petitioner fails to deposit Rs. 5,61000/- within three months in the account of the firm/ company, the learned court below shall cancel the bail bond of the petitioner.
