Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Shyampur Bhatha P.S. Case No. 16 of 2011, registered for the offences punishable under Sections 353, 307, 120(B)/34 of the Indian Penal Code and section 27 of the Arms Act.
It is submitted that petitioner has been falsely implicated in this case. Name of this petitioner has come on the basis of confessional statement of co-accused Chandan Kumar Patel who was apprehended on the spot. Similarly situated coaccused Chhote Chaudhary has been granted anticipatory bail
Patna High Court CR. MISC. No.33494 of 2020(3) dt.16-12-2020 2/2 by a Coordinate Bench of this court vide order dated 10.11.2016 passed in Cr. Misc. No. 36153 of 2016 (Annexure-2). Petitioner has got clean antecedent, as stated in para 3 of the petition. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sheohar in connection with Shyampur Bhatha P.S. Case No. 16 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
