====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-04-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 363 and 365 of the Indian Penal Code.
3. As per the prosecution case, wife of the informant left the house with cash and jewellery but she did not return. Informant suspects that petitioner abducted his wife with intention to sell her. Earlier also, petitioner had taken away wife of informant but police recovered her from a restaurant.
4. Learned counsel appearing for the petitioner submits that the petitioner and the informant's wife are known to each other and she went with the petitioner on her own accord. In fact, she wanted to marry with this petitioner but petitioner refused to marry, so in retaliation she implicated this petitioner. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer for bail. He submits that the victim in her statement recorded
Patna High Court CR. MISC. No.12537 of 2025(3) dt.15-04-2025 2/2 under section 164 of the Code of Criminal Procedure, has supported the allegation and has stated that the petitioner kept her in confinement and subjected to sexual exploitation.
6. Considering the nature and gravity of allegation and aforesaid statement of the victim, prayer for bail of the petitioner is rejected.
