The petitioner, who is in custody, seeks bail in connection with Alamganj P.S. Case No. 314 of 2017 registered for the offence punishable under Sections 399/402of the Indian Penal Code and 25 [1-b] A, 26/35 of the Arms Act. Allegation against the petitioner is of recovery of one loaded country made pistol with one loaded cartridges, three cartridges and 4000/- in cash from his full pant. Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case and he is in custody since 14.08.2017.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.2708 of 2018(3) dt.09-02-2018 2/2 the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. (V), Patna City, in connection with Alamganj P.S. Case No. 314 of 2017.
