JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 01-05-2017 Inter alia contending that there is encroachment in public land bearing Khata No. 242, Khesra No. 1252, Village-Pokhra, P.S.- Kotwa, District- East Champaran, this petition has been filed in public interest.

2. Considering the fact that the petitioner has statutory remedy of making a complaint in this regard before the Statutory Authority under the Bihar Public Land Encroachment Act, we are not inclined to interfere into the matter, instead grant liberty to the petitioner to file an appropriate application before the Statutory

Patna High Court CWJC No.19593 of 2016 dt.01-05-2017 2/2 Authority under the Bihar Public Land Encroachment Act and if such an application is filed, the authority shall proceed to take action on the application, hear all concerned and take decision in the matter within six months from the date of its presentation. Needless to emphasize that we have not expressed any opinion on the merits of the allegation made and it is for the Statutory Authority to proceed in accordance with law.

3. With the aforesaid, the writ application is disposed of.
