JUSTICE SANDEEP KUMAR ORAL ORDER 21-12-2021 Heard the learned counsel for the petitioner and Mr. Ram Priya Sharan Singh, learned APP for the State. This application for anticipatory bail in connection with Dagarua P.S. Case No. 219 of 2019, for the offence punishable under Sections 341, 323, 325, 326, 307, 379, 504, 506, 34 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that there is general and omnibus allegation leveled against all the accused persons of assaulting the victim on his head which caused a grievous injury. He also submits that one Ram Swaroop Rishi had already been arrested in this case. Considering the above submission, let the petitioner be enlarged the petitioner above named, in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)

No.23162 of 2021(2) dt.21-12-2021 2/2 with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Dagarua P.S. Case No. 219 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, with condition that before accepting the bail bond of the petitioner, the court below shall verify the submission whether the Ram Swaroop Rishi has taken into custody or not, if he has taken into custody, the bail bond of the petitioner shall be accepted, if he is not taken into custody, the bail bond of the petitioner shall not be accepted, he will take into the custody.
