JUSTICE ARUN KUMAR ORAL ORDER 19-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Khaira PS Case No. 141 of 2002 registered under Section 395 of the IPC and Section 17 C.L. Act.

The allegation in brief is that while the informant was engaged in doing photography of the electorate for preparation of election I-Card, some unknown extremist came armed and snatched away camera I-Card of the electorates.

Learned Counsel for the petitioner submits that the FIR is against unknown, there is no material against the petitioner except disclosure of his name by one of the witnesses but he has no criminal antecedent and he was not put on TIP, besides this he is in custody since 13.5.2017.

Having considered the said facts and circumstances, the petitioner, namely, Fajal Mian is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Jamui in connection with Khaira PS Case No. 141 of 2004.
