JUSTICE ARUN KUMAR ORAL ORDER 09-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Maner P.S.Case No. 89 of 2017 registered under Sections 302/34 of the Indian penal Code and 27 Arms Act. Allegation in brief is that accused persons named in the FIR killed the deceased.
Submission is that petitioner is not named in the FIR and there is no any specific evidence except two of the co-accused disclosed the name of the petitioner regarding his participation. However, similarly situated two accused persons, one by this Court and another by a co-ordinate Bench of this Court, have been admitted to bail vide order dated 02.02.2018 passed in Cr. Misc. No. 308 of 2018 and vide order dated 5198 of 2018 in Cr. Misc. No. 5198 of 2018.

No.7948 of 2018 (2) dt.09-02-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Hariom Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. Sandeep Kumar, J.M., 1st Class, Danapur in connection with Maner P.S. Case No. 89 of 2017.
