The petitioner is apprehending his arrest in connection with Besfi (Patauna) P.S.Case nO.129 of 2018 , registered for offences punishable under Sections 147, 148, 341, 307, 353, 149, 324, 332, 333, 353, 109, 114, 117, 427, 379, 504, 506, 511 of the Indian Penal Code and 3 D.P.P.Act.

Allegation as per FIR is that one person was arrested on suspicion of child lifter and he was under assault by the several persons on which the police reached there and thereafter the accused persons started assaulting the police party also. The petitioner is named in the FIR.

Submission of the learned counsel for the petitioner is that he is not the resident of same village rather he is of different village though he is named along with 36 other

Patna High Court CR. MISC. No.13822 of 2019(2) dt.06-03-2019 2/2 accused persons and 300 unknown persons but no specific allegation has been attributed against him and as he has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Benipatti in connection with Bisfi (Patauna) P.S.Case no.129 of 2018, corresponding to G.R.No.443 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
