The petitioner seeks regular bail in connection with Guraru P.S. Case No. 84 of 2010 lodged under Sections 302/34 of Indian Penal Code read with Section 27 of the Arms Act. As per the prosecution story, the informant has alleged that 8 to 10 members of the Naxal organization have taken the deceased and thereafter the family of the informant got the dead body of the deceased. In the F.I.R. suspicion were made against 5 known and 4 to 5 unknown persons, the name of petitioner was figured in known persons.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence, there is no eyewitness of the alleged occurrence, no specific role has also been attributed against the petitioner. Learned counsel for the

Patna High Court CR. MISC. No. 13707 of 2022(2) dt.08-07-2022 2/2 petitioner further submits that petitioner is in custody since 11.12.2021 and charge sheet has already been filed in this case. He further submits that petitioner carries criminal antecedent but in the present case, nothing against him.

In the present facts and circumstances of this case, let the petitioner be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Guraru P.S. Case No. 84 of 2010, subject to the conditions as laid down under 437(3) of Cr.P.C.

The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.
