Permission is granted.
Heard Mr. Chitranjan Sinha, learned Senior Counsel assisted by Mr. Sanjay Parasmani for the appellant and Mr. Sadanand Paswan, learned Special P.P. for the State. Vide order dated 04.01.2023, prayer for grant of anticipatory bail to the appellants was permitted to be withdrawn in Criminal Appeal (SJ) No.3923 of 2022 with a direction to the appellants to surrender before the learned Court below within six weeks from the date of the order and seek
Patna High Court CR. APP (SJ) No.1142 of 2023(2) dt.15-03-2023 2/2 regular bail, but the appellant has not surrendered before the learned Court below and again moved before this Court for grant of anticipatory bail.
Learned Senior Counsel for the appellant submits that some important points had not been raised at the time of argument in Criminal Appeal (SJ) No.3923 of 2022. Considering the fact that vide order dated 04.01.2023, prayer for grant of anticipatory bail to the appellants was permitted to be withdrawn in Criminal Appeal (SJ) No.3923 of 2022 and the appellant has not surrendered before the learned Court below, as directed by this Court, I am not inclined to entertain the instant appeal.
