2. The petitioner seeks bail in Vijaipur P.S. Case No. 376 of 2023, instituted for the offences punishable under Section 393 of the Indian Penal Code.

3. The prosecution case, in short, is that, three unknown miscreants attempted to make robbery in the jewellery shop of the informant but, failed to execute it and fled away from the spot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the F.I.R. and

Patna High Court CR. MISC. No.11955 of 2025(2) dt.21-02-2025 2/3 his name has surfaced in this case in course of investigation merely on the basis of suspicion. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. The petitioner in in judicial custody since 10.09.2024 and has got six criminal antecedents details of which has been given in Para-3 of the present bail petition. Learned counsel for the petitioner further submits that the co-accused namely Suraj Ram has been granted bail by this Court vide order dated 24.07.2024 passed in Cr. Misc. No. 48592 of 2024.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the petitioner has altogether six criminal antecedents.

6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner as also the prayer for bail being based on parity, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail, after framing of charge if not already framed, on furnishing

Patna High Court CR. MISC. No.11955 of 2025(2) dt.21-02-2025 3/3 bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Vijaipur P.S. Case No. 376 of 2023.
