JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

On information, received by the police that co-accused Awdhesh Kumar Singh is dealing with stolen motorcycle, a raid was laid and from the houses of Awdhesh Kumar Singh, Kamlesh Kumar and Ashif stolen motorcycles were recovered and Awdhesh Kumar Singh named the petitioner and suggested that the recovered motorcycle from his house was purchased from the petitioner.

It is submitted by learned counsel for the petitioner that no recovery was made from the petitioner and co-accused

Patna High Court Cr.Misc. No.15091 of 2015 (6) dt.14-05-2015 2/2 Kamlesh Kumar from whom the recovery was made has been granted anticipatory bail vide Criminal Miscellaneous No. 51269 of 2013.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Samastipur in connection with Bangra P.S. Case No.49 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bond of the petitioner will be accepted on filing of the affidavit by the petitioner before the learned court below to the effect that he will regularly co-operate in the investigation. Non-cooperation in the investigation by the petitioner will give liberty to the learned court below to cancel the bail bonds of the petitioner.
