2. The petitioner has preferred this application for grant of regular bail in connection with Sadar Hajipur P.S. Case No. 690 of 2023, registered for the offences punishable under Sections 341, 323, 379, 420, 506 read with Section 34 of the IPC and charge-sheet has been submitted under Sections 395 and 397 of IPC.
3. As per allegation, when the informant was going to Arsad Nagar, on the way, four unknown miscreants stopped his vehicle and started assaulting him with lathi, danda and snatched his mobile phone. After that, through pay phone of his mobile, they transferred Rs.1,04,400/-. After that, they threw his

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has transpired in this case in the confessional statement of the co-accused, Nitin Kumar. Nothing has been recovered from the possession of the petitioner. No T.I.P. has been conducted by the prosecution. The petitioner has no concern with the alleged occurrence. The petitioner has three criminal antecedents in which he is on bail in all cases as stated in para 3 of the bail petition. The petitioner is in custody since 03.10.2023. The co-accused has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 14.02.2025 passed in Cr. Misc. No. 80579 of 2024.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Sadar Hajipur
Patna High Court CR. MISC. No.13840 of 2025(2) dt.19-04-2025 3/3 P.S. Case No. 690 of 2023, with the condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
