Petitioner is in custody since 26.08.2016 in connection with Basantpur P.S. Case No. 177 of 2016 registered under Sections 326, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact, there is land dispute between the parties and both the parties have sustained injuries, which is evident from Annexures-2 and 3. Moreover, charges have been frame in this case, which is evident from the supplementary affidavit filed on behalf of the petitioner and the petitioner is rotting in custody for the last nine months.
Considering the facts and circumstances of the case, let
Patna High Court Cr.Misc. No.2013 of 2017 (4) dt.22-06-2017 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Basantpur P.S.
