2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 309(6) of the BNS.

3. The case of the prosecution, in short, is that while the informant and his neighbor Naresh Yadav were returning on the Splendor motorcycle from market. As they reached Bhelwa Chowk, three unknown miscreants on a bike bearing registration no. BR43AF6478 overtook them and started abusing and stopped them. The miscreants on gun point, took away Rs.1,500/- and a mobile of the informant.

4. Learned counsel for the petitioner submits that the name of this petitioner has surfaced in this case on the confessional statement of Chandan Kumar and it has further been submitted that the petitioner has been remanded in this case from

Patna High Court CR. MISC. No.13848 of 2026(2) dt.12-03-2026 2/2 Madhepura P.S. Case No. 827 of 2025 wherein he has given his confessional statement. Learned counsel for the petitioner has submitted that save and except the confessional statement there is nothing against the petitioner. No recovery has been made from his possession. No TIP was conducted. Learned counsel for the petitioner has further submitted that the petitioner is in judicial custody since 26.09.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail and has submitted that the petitioner is having criminal antecedent of six cases.

Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with the condition that the petitioner shall co-operate in the trial and shall remain physically present on each and every date in the trial court and shall mark his attendance weekly at Madhepura P.S. The above named petitioner is directed to be released on bail in connection with Madhepura P.S. Case No. 826 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura.
