JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-04-2018 The petitioner seeks bail in anticipation of his arrest in connection with Teghra P.S. Case No. 261 of 2017, dated 14.09.2017, instituted for the offences punishable under Sections 458 and 380 of the Indian Penal Code. Three unknown miscreants had, after taking the keys from the sacred thread of the informant, took away Rs. 55,000/- in cash from the Almirah and the mobile phone was also taken away.

The petitioner is not named in the First Information Report and his name has only transpired on the

Patna High Court Cr.Misc. No.15759 of 2018 (2) dt.05-04-2018 2/2 confession of a co-accused/Radha Krishna Choudhary @ Baua, who is on inimical terms with the petitioner. It has been submitted on behalf of the petitioner that the mother of the aforesaid co-accused/Radha Krishna Choudhary @ Baua had also lodged a case against the petitioner and his parents, about which reference has been made in paragraph 3 of the petition. Apart from the confession of co-accused/Radha Krishna Choudhary @ Baua, there is no other material to connect the petitioner with the crime. Nothing has been recovered from the possession of the petitioner.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S.
