This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Madhepura (Bharrahi O.P.) PS Case No. 148 of 2018 for the alleged offence punishable under Section 392 of the Indian Penal Code.
Learned counsel representing the petitioner submits that name of the petitioner surfaced on the confessional statement of the co-accused Rupesh Kumar. He further submits that petitioner has no criminal antecedent and he is in custody since 19.01.2019. In the instant case, seizure list was not prepared in terms of the mandatory provision of Section 100 of
Patna High Court CR. MISC. No.13676 of 2019(2) dt.06-03-2019 2/2 the Code of Criminal Procedure.
Considering the fact that petitioner has no criminal antecedent and he is in custody since 19.01.2019, this application is allowed. Accordingly, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura (Bharrahi O.P.) PS Case No. 148 of 2018.
