Petitioners seek regular bail in a case registered for the offence punishable under Section 420 and some other allied Sections of the Indian Penal Code and u/s 66(c ), 66(d) of the I.T. Act.

As per the prosecution case, on secret information that some persons in the name of providing gift enticing the people, raid was conducted and these petitioners along with other accused persons were apprehended and on search from the possession of petitioner No. 1 three mobiles and 20 copies of order sheets containing the names of customers along with

Patna High Court CR. MISC. No.13896 of 2022(2) dt.12-05-2022 2/2 mobile numbers and from possession of petitioner No.2 one mobile and 25 copies of order sheets containing the names of customers along with mobile numbers were recovered. Learned counsel appearing for the petitioners submits that no incriminating articles has been recovered from the conscious possession of the petitioners. Nobody has come forward to say that he was cheated by the accused persons and only on suspicion petitioners have been made accused in this case. Petitioner claims clean antecedent and is in custody since 15.01.2022 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Nalanda at Biharsharif in connection with Giriak (Katrisarai) PS case No.16/2022.
