JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,325,307 and 506/34 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that on 17.9.2015 at 9.15 P.M. the informant's brother namely Sintu Kumar was surrounded by Ram Kishore Singh alias Julumdhari Singh, petitioner, Chhotu Kumar alias Shalendra Kumar and Gopi Kumar when they fired the shot. It is specifically alleged that firing was made by the petitioner.

It is submitted by the learned counsel for the petitioner that the brother of the informant received one lacerated injury on the back of the head caused by hard and blunt substance while the

Patna High Court Cr.Misc. No.10506 of 2016 (2) dt.08-03-2016 2/2 other injury is complain of headache and nausea. Subsequently, the brother of the informant was referred to P.M.C.H. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the accusation being nor corroborated with the medical opinion and Statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Patnacity in connection with Khusrupur P.S. Case No. 187 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on three consecutive occasions. (Dinesh Kumar Singh, J) Anil/- U T
