JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 12-03-2019 The appellant seeks pre arrest bail in connection with Mehandiganj P.S. Case No. 70 of 2018, registered for offences punishable under Sections 341, 323, 363, 366(A) of the Indian Penal Code and Section 3(x)(i) of SC/ST Act.
Allegation as per F.I.R. is that husband of the appellant eloped with the daughter of the informant and when informant went to the house of appellant to enquire the matter, appellant said to have abused the informant and also threatened her. It has been submitted on behalf of the appellant that the daughter of the informant has been recovered and her statement under Section 164 Cr.P.C. has been recorded, in which, she has not named the appellant and further there is no allegation against the appellant of abusing the informant by caste name.

Having heard both sides, considering the facts and circumstances of the case, let the appellant, above named, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -IX-cum-Special Judge, SC/ST Act, Patna, in connection with Mehandiganj P.S. Case No. 70 of 2018, subject to the conditions laid down under Section 438 (2) of Cr.P.C.
