2. The petitioner seeks bail in connection with Kurtha P.S. Case No. 265 of 2024, instituted for the offence punishable under Sections 191(2), 191(3), 109, 329(4), 352, 351(2), 126(2) of the B.N.S. and u/s 25(1-B)a, 26/35 of the Arms Act.
3. The prosecution case, in short, the petitioner and other accused persons armed with pistol and iron rod alleged to have entered into the house of the informant and abused her and her husband. It is further alleged that petitioner fired with his pistol but could not hit anybody.
4. Learned counsel for the petitioner submits that the petitioner in innocent and has falsely been implicated in the present case on account of property dispute. The informant's husband and father of the petitioner are full brother and there is

No.12121 of 2025(3) dt.12-05-2025 2/2 dispute with respect to the partition of family property and for that informant side filed Partition Suit No. 111/09 against the father of the petitioner. No incriminating material has been recovered from the possession of the petitioner. Petitioner has no criminal antecedent and he is in custody since 21.11.2024. Learned counsel further submits that after completion of investigation, charge-sheet has been submitted against the petitioner.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Kurtha P.S.
