Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code, Section 27 of Arms Act and 16, 17, 18, 19, 20, 21 and 22 of the U.A.P. Act.

The FIR relates to murder of Kunal Yadav.

Suspicion is there against the petitioner and others also for the reason that some of the witnesses have last seen the deceased alongwith the petitioner and others on motorcycle. Submission of the learned counsel for the petitioner is that confessional statement of co-accused Bharat Yadav was recorded in connection with Sono (Charkapathar) P.S.Case No.97 of 2017 wherein he took

Patna High Court Cr.Misc. No.16030 of 2018 (2) dt.21-03-2018 responsibility on behalf of the Naxal to have committed the murder of Kunal Yadav. Only material against the petitioner is confessional statement of the petitioner before the police which is no evidence in the eyes of law.

Learned counsel for the informant opposed the prayer for bail.

Considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sono (Charkapathar) Police Station Case No.164 of 2016, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
