This is a petition for grant of regular bail in connection with Special Case No. 22 of 2017 C.I.S. No. 23 of 2017 arising out of Dagarwa P.S. Case No. 203 of 2017 for offences under Sections 8, 20(b)(ii)(c), 25 and 29 of the Narcotic Drugs and Psychotropic substances Act. Allegation, in brief, is that on secret information large consignment of ganja was coming from Tripura and some vehicle is also escorting the said truck. On receiving the information the Scorpio vehicle of the petitioner was also stopped by the police and truck was also seized by the police where-from recovery of 71 bags of ganja, in total 726.800 Kgs, was made.
Submission of the learned counsel for the petitioner
Patna High Court Cr.Misc. No.15777 of 2018(2) dt.21-03-2018 2/2 is that petitioner is not connected with the truck. He is the driver of the Scorpio vehicle bearing registration no. BR-11M7681 and engaged by it's owner on daily basis, except two mobiles nothing has been recovered from the possession of the petitioner and he has clean antecedent.
Having considered the facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Special Case No. 22 of 2017 C.I.S. No. 23 of 2017 arising out of Dagarwa P.S. Case No. 203 of 2017 to the satisfaction of the Sessions Judge, Purnea.
